Regulation 27 of Subsidiary Legislation 549.134, the beverage container refund scheme Regulations, stipulates interalia that:

In accordance with the provisions establishing CEMalta, particularly S.L 549.134, the Government shall be monitoring, auditing and enforcing as necessary the Scheme through the Agency. CEMalta shall be effectively exercising its regulatory role through established relationships and support of the Customs of Malta and the Commissioner for Revenue.

CEMalta shall be working together with other authorities to ensure that the Operator of the Scheme, as well as Producers, Importers, Distributors, Retailers, and Catering Undertakings follow the rules and regulations set out in the legal notice amongst others to ensure that objectives and targets are attained.

The regulations published on the 31st July 2020 also provide that if the relevant targets are not attained, the Operator would be subject to fines, as appropriate.
